General Terms and Conditions

1. Scope

The following General Terms and Conditions apply to all orders placed through our online shop. Our online shop is directed exclusively at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Madgems GmbH, Motschental 22, 96450 Coburg, Germany.

By listing the products in the online shop, we submit a binding offer to conclude a contract for these products. You may initially place our products in the shopping cart without obligation and may correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the order process. The contract is concluded when you accept the offer for the products contained in the shopping cart by clicking the order button.

Immediately after submitting your order, you will receive a confirmation by email.

3. Contract Language, Storage of the Contract Text

The languages available for concluding the contract are German and English. The German version of these General Terms and Conditions shall prevail.

We store the contract text and send you the order details and our General Terms and Conditions in text form. For security reasons, the contract text is no longer accessible via the internet.

4. Delivery Terms

4.1 Shipping Costs

The shipping costs incurred are not included in the purchase price and are shown separately during the order process. They depend on the respective country of delivery, the shipping service provider and the scope of the order.

4.2 Delivery Options

We ship the products to the delivery address specified during the order process. We deliver by shipping only; collection of the goods in person is not possible.

5. Payment

5.1 Prices

The prices stated at the time of the order apply. These are total prices and include statutory VAT. In certain cases, margin taxation pursuant to Section 25a UStG (German VAT Act) applies; such items are marked accordingly. For items subject to margin taxation, VAT is not shown separately.

5.2 Payment Methods

The following payment methods are generally available in our shop.

Advance payment
If you select advance payment, we will provide our bank details in a separate email and deliver the goods once payment has been received.

Credit card
You provide your credit card details during the order process. Your card will be charged immediately after your order has been placed.

SEPA direct debit
By placing your order, you grant us a SEPA direct debit mandate. We will inform you of the date on which your account will be debited at least one banking day in advance (prenotification). A banking day is any working day with the exception of Saturdays, nationwide public holidays and 24 and 31 December of each year. Your account will be debited before the goods are dispatched.

PayPal, PayPal Express
In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order has been placed. Further information is provided during the order process.

PayPal may offer registered PayPal customers selected according to its own criteria additional payment terms within their customer account. We have no influence over whether such terms are offered; any individually offered payment terms concern your legal relationship with PayPal.

Further payment methods offered in our shop (including Klarna, Apple Pay, Google Pay, Shop Pay, Bancontact, EPS, iDEAL, Wero and MobilePay) will be displayed during the order process. The information provided there and the terms of the respective provider apply.

6. Right of Withdrawal

Consumers have a statutory right of withdrawal. Please refer to our Right of Withdrawal notice for details.

7. Warranty and Guarantees

7.1 Liability for Defects

The statutory rules on liability for defects apply.

7.2 Guarantees and Customer Service

Information on any additional guarantees that may apply and their precise conditions can be found with the respective product and on dedicated information pages in the online shop.

8. Dispute Resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Contract language and translations
The contractual language is German. English and other translations of these Terms and Conditions are provided for convenience only. In the event of any discrepancies or inconsistencies between the German version and a translation, the German version shall prevail, to the extent permitted by mandatory applicable law. Mandatory consumer protection rights remain unaffected.
